The US Justice Department has officially joined a legal challenge initiated by California Republicans, seeking to halt the state's recently passed congressional redistricting map.
This court case, submitted to a US district court, challenges the redistricting plan championed by Governor Gavin Newsom, which was developed in reaction against a Republican-led gerrymander in Texas.
"California's redistricting scheme constitutes a blatant attempt to seize control that violates voting rights and mocks the electoral system," declared the US attorney general.
The Democratic party have voiced assurance that the redistricting plan will withstand legal scrutiny.
"The plaintiffs were defeated in the election and they are likely to face defeat in the judicial system," stated a representative for the governor.
Legal Basis
The lawsuit claims that California's map wrongfully utilized race as a factor to heavily favor Hispanic voters in contravention of the US Constitution.
"Race cannot be used as a substitute to advance political interests, but that is precisely what the state legislature did with Proposition 50," argued a high-ranking representative from the Civil Rights Division.
Political Context
The legal battle represents the major response by Democrats in the continuing redistricting war that began in Texas and has extended to various parts of the country.
In contrast to elsewhere, where Republican state legislatures have enacted gerrymanders, California's plan required public consent, which it received with approximately two-thirds of the vote.
Wider Consequences
The Democratic party need to flip just a small number of GOP-controlled House seats to take control of the House of Representatives in next year's congressional elections.
The political group controlling the majority will shape the final years of the sitting president's term, deciding if a GOP-controlled legislature will continue to deliver its agenda or face resistance, investigations and possible further challenges.
